Terms and conditions

These terms and conditions are part of our applicable policies and procedures for all types of business relationships with our customers, regarding payment, accreditation, cancellation, refund, or application of financial advances ("Advance") for the purchase offer of private units ("Apartment") that a customer makes at pre-sale events or directly at the offices where the AAHAL® project model is exhibited.

AAHAL® will determine and authorize in advance and unilaterally the payment method and fixed minimum amount for receiving Advances related to the promoted Project, including but not limited to: (i) transfer of funds to the bank account indicated by AAHAL®, (ii) charging to plastic cards (credit or debit) at point-of-sale terminals contracted by AAHAL® for this purpose, or (iii) cash deposits at AAHAL® made by the customer directly at the banking institution. The customer is obligated to keep the original payment receipt and send a copy of it to AAHAL®.

Once the Advance is credited to the account, AAHAL® will contact the customer to confirm the day, time, and location that the customer indicated when formulating the participation requirements in AAHAL®'s pre-sale events, in order to proceed with the signing of the purchase promise for the Apartment (the "Promise"). If the customer fails to appear for the Promise signing on the scheduled day or decides not to sign it, the customer is authorized to cancel the effects of the Advance and request its refund within 5 (five) calendar days following the payment of the Advance, subject to the following conditions:

A. The customer must send an email to the address: contacto@aahal.com indicating the reason for the cancellation and attaching to the email in PDF Acrobat format each and every one of the following documents:
A simple copy of the cover page of the customer's bank statement, in the customer's name, to which the 100% (one hundred percent) of the Advance will be refunded, with a maximum age of 3 months.

A simple copy of the customer's valid official identification (valid Passport, Voter ID Card with Photograph, Professional License).

A simple copy of the customer's proof of address with a maximum age of 3 months.

The refund of the entire Advance will be made within 15 (fifteen) business days following the date on which the customer submits all of the aforementioned documents, with the understanding that the refund of all Advances made by charging to plastic cards (credit or debit) or electronic transfer will be made without exception through electronic transfer to the customer's bank account, for which a simple copy has been provided for the refund of the Advance. However, cash deposits made by the customer will be refunded through direct payment at the bank branch indicated by AAHAL®, upon delivery to the respective executive of the key/password that AAHAL® notifies in writing.

The details of the terms and conditions offered for the purchase of an Apartment in the AAHAL® Project, delivery deadlines, sale price, earnest deposit payments, and any breaches by the offeror will be agreed upon in the Promise that will be signed on the confirmed appointment day with the customer. Once the Promise is signed by the customer, the entire Advance will be applied and subject to the terms and conditions of the earnest deposit established in the Promise. Any deviation from these terms and conditions of sale, as well as complementary agreements and/or any other agreement outside of what is established, will only be valid if expressly stated and in writing by AAHAL®.

AAHAL® has clear corporate policies that describe the rules and responsibilities that every employee must adhere to regarding bribery, corruption, gifts and hospitality, sponsorship and donations, fraud, money laundering, conflicts of interest, third-party investigations, and reporting.

The Integrity Policy is communicated and applicable to all employees, relevant executives, committee members, and external parties who interact with AAHAL®.

SCOPE OF THE CODE OF ETHICS AND CORPORATE POLICIES

When referring to AAHAL®, we mean Desarrolladora MHRS S.A. de C.V., its shareholders, subsidiaries, related companies, and their entities.

The individuals responsible for compliance with both the Code of Ethics and the Corporate Policies and their inherent procedures are: Directors, Executives, Employees, Suppliers, Service Providers, individuals interested in establishing business relationships with AAHAL®, and Clients, if applicable.

AAHAL® promotes and commits its executives to model and lead by example the culture of compliance and high ethical standards.

COMPLIANCE AND COMMITMENT TO LEGALITY
COMPLIANCE POLICY

AAHAL® is committed to complying with all applicable national and international regulations. Therefore, with the aim of ensuring compliance and establishing a zero-tolerance philosophy regarding behaviors that may involve non-compliance with current regulations and internal policies and procedures, it incorporates a compliance function within its structure. This function is responsible for monitoring compliance and, if necessary, taking appropriate action, including imposing labor or even legal sanctions for non-compliance.

ANTI-CORRUPTION, BRIBERY, AND FRAUD POLICY

AAHAL® minimizes its exposure to fraud, corruption, bribery, or facilitation payments by developing and implementing effective and efficient policies, procedures, and controls to prevent such occurrences.

ANTI-MONEY LAUNDERING POLICY

AAHAL® establishes the necessary structures and resources, including human, financial, process, and technological, to implement, continuously monitor, and keep the Anti-Money Laundering (AML) program up to date and reliable. This program aims to prevent transactions involving illicit funds and ensure compliance with applicable legislation in a timely manner.
